The “alleged” violation of the DAO of the National Police in Spain, of an inspector under its command, violates the most basic human rights of the victim

The “alleged” rape complaint linked to the Deputy Operational Director (DAO) of the Spanish National Police, José Ángel González, opens the door to an investigation where little is expected from political leaders. And almost nothing from those responsible for the police.

The deputy operational director (DAO) of the National Police, José Ángel González Jiménez, until now number two of the force, has been reported for sexual assault with penetration and has had to resign from his position.

The events narrated in the complaint occurred on April 23, 2025. That day, and apparently, according to statements by the complainant’s lawyer, she was taken to the address of the DAO of the PN without a clear pretext, but under orders of due compliance. At that address and apparently for just over 40 minutes, as recorded in a recording that the complainant herself made, this police officer forced her and ended up raping her.

According to the complainant’s story, González allegedly forced the agent into her official home, taking advantage of her position of authority. There is talk of sexual assault with penetration, coercion, psychological injuries and subsequent harassment, all with the aggravating circumstance of abuse of institutional superiority. The complaint also alleges that the victim was subjected to pressure and insistent calls and even offers of employment in exchange for silence from nearby police officers. Therefore, it would not be strange if in the coming days either new resignations emerge or the police investigation, which is most likely carried out by members of the Judicial Police of the Civil Guard, reveals new details about the event and the person in question.

The complainant contributed audio recordingsmessages and call logs as part of your complaint.

But while what is happening is relevant, the ordeal that the victim has had to go through in a democratic country like Spain and guarantor of the human rights of those who are victims of sexual predators is no less relevant.

In the case at hand, the inspector whose name I will hide, although it has already been published with the sole purpose of further violating her rights, suffered the harassment that she manifests in her complaint, from the very moment of the events, and although they tried to buy her by giving her whatever destination she wanted, she remained firm until, unable to take it anymore, she asked her family doctor for stress leave, and not through the usual police means, with the sole purpose of presenting a low profile, while she tried to heal and decide what to do. Despite the short time that had passed, in October he contacted a lawyer with the aim of filing a complaint against the DAO of the National Police. Complaint that was filed directly in court, trying to make as little noise as possible, out of fear that the person or people who violated their most basic rights would not find out about it until they had completed their objective. That happened on January 17, when it was admitted for processing.

During all these months of sick leave, no one from the General Police Corps has contacted her, not even to ask her what her health status was. They have been allowing him to submit the sick leave reports without being interested in one of his inspectors. Which leads us to two conclusions: either there is negligence in the fulfillment of the duty of surveillance by the competent body to ensure the health of the agents of the National Police Corps, or there was some type of order to leave said person alone, by some higher command, who, upon seeing that nothing had been reported by the inspector, believed themselves to be safe.

If the victim filed the complaint and received her psychological treatment outside the police force, it is because she did not feel safe at all and feared that once it became known that she was in the process of filing a complaint and recovering, they could again harass her or extort her in some way. The exact word with which your emotional state has been described is Fear. She had and has an enormous and deep fear of everything they could do or say about her. Will all responsibilities be cleared or covered?

This case broke out to the Government of Pedro Sánchez, but above all to the Minister of the Interior Grande Marlaska, giving rise to the implementation of various actions, where no one, it seems, knows absolutely anything.

As soon as the news was known, the general director of the Police, Francisco Pardo Piqueras, summoned the senior officers of the force to address the crisis after the resignation of the DAO and analyze the institutional impact of the case. The Minister of the Interior ordered confidential information that has led to the dismissal of Commissioner Óscar San Juan, González’s right-hand man, to investigate whether he participated in alleged pressure on the complainant, as stated in the complaint.

Of course, from the first moment police unions such as JUPOL demanded the immediate resignation of the DAO and also of the Minister of the Interior for his management. Other unions have called for caution, respecting the presumption of innocence and the protection of the victim. In this case, I would like to comment, and it is an opinion, that since there is a recording where you can hear everything that happened, including the development of the events, it is difficult for me to think that a police union would ask for caution. For now, what you should be is horrified, and if you are a woman, even more so. In fact, and due to this strange corporatism and preventing possible future defenses of the DAO’s lawyer, the defense of the National Police inspector has requested expert testimony of the recording evidence and that this be done by members of the Civil Guard, and not her own colleagues. Throughout this journey, both the agent who has claimed to have been raped and her lawyer have wanted, from April 23, 2025, until October of this year, when she requested legal advice, to distance herself as much as possible from the environment of the National Police, for fear of what could happen to her.

Marlaska has stated in the Congress of Deputies that he and his services were not aware of the complaint before it was public, and that he has not “covered up” anything. And he has defended that, once the existence of the complaint was known, the immediate resignation of José Ángel González was demanded and that he submitted his resignation to “protect the image of the Police” and, I imagine, although no one has said this, that if he resigned, legally he would not be in the same situation as if he were fired. The Government is insisting that it has acted with empathy and consistency towards the complainant, and that the priority must be respect for the judicial investigation and the protection of the affected person. However, today, at this time, his lawyer has not tired of stating in the media that no one from the Government or the Police has called the victim or him as her lawyer, to be interested in her, her health or her needs. Zero empathy. Although if they feel the same empathy as for the relatives of those who died in Adamuz, the poor inspector will be able to sit and wait for a call for support.

But the most insulting and mean phrase was undoubtedly said by Marlaska in Congress, when he stated that he would only resign if the victim considered that she was not protected by him or by his management. I already tell you that she was not protected, I already tell you that your fear of the DAO was real at all times and I already tell you that placing the weight of the possible decision of you falling or resigning on her is a lack of style, only comparable to the words of Oscar López, when he stated that the elections in Aragon were lost because of a dead person. Infamous.

Furthermore, when a few months ago you extended your retirement in a somewhat strange way, putting you in charge as DAO (Deputy Operational Director of the National Police), it does not make you guilty for your demerits, at least politically. By the way, remember that when he was appointed, the Government of Pedro Sánchez was full of plumbers who constantly attacked the UCO (Central Operational Unit of the Civil Guard) trying to discredit it and that there was talk that the decision to appoint José Ángel González Jiménez was only to try to silence, with the control of other investigations, the noise that this elite unit of the Civil Guard was making.

Mr. Marlaska, I am clear that most likely the person directly affected by the possible sexual demands of the DAO of the National Police is not going to address you, much less to ask you to resign, regardless of you and your conscience. But I can assure you that very possibly if we start looking at other cases of the body, there would surely be some women who would not have the slightest shame in asking him to leave.

I repeat, at this time, no one empathetic has called the victim or his lawyer to help him with whatever he needs. Oh, and the feminists preparing the banners for March 8, but without saying a single word about this story.
