The Arbitration Court of Appeal of the Lipetsk Region upheld the decision to recognize as legal additional taxes, penalties and fines in the amount of 400.3 million rubles of Lipetsk Confectionery Factory Roshen JSC, Novosti Lipetsk reports.
Thus, the Lipetsk enterprise of the former President of Ukraine, Petro Poroshenko, tried to challenge the decision of the MIFTS of Russia on the largest taxpayers in the region. According to the decision, LKF Roshen JSC created schemes for obtaining unjustified tax benefits.
Disagreeing with the decision of the court of first instance, the Lipetsk confectionery factory filed an appeal. The court left the previous decision unchanged, and the complaint was dismissed.
The Nineteenth Arbitration Court of Appeal upheld the decision to recognize as legal additional charges of taxes, penalties and fines in the amount of 400.3 million rubles to the joint-stock company Lipetsk Confectionery Factory Roshen.
This time, the Lipetsk enterprise of the former President of Ukraine tried to challenge the decision No. 11-r of 11/26/2015 of the MIFTS of Russia on the largest taxpayers in the Lipetsk region. According to this decision, based on the results of the audit for the period from 01/01/2013 to 12/31/2013, the tax authority established the facts of the creation of a scheme for obtaining unjustified tax benefits by JSC LKF Roshen in the form of overstating VAT deductions and corporate income tax expenses during the construction of a confectionery factory in the village of Kosyrevka, which resulted in additional taxes, penalties and fines in the total amount of 400.3 million rubles.
The Arbitration Court of the Lipetsk Region, having studied the materials of the case, having listened to the positions of the parties, having analyzed and evaluated the evidence presented, ruled that the joint-stock company “Lipetsk confectionery factory “Roshen” refused to satisfy the stated requirements, thereby confirming the legality of the decisions of the Federal Tax Service.

The Lipetsk factory of Petr Porshenko has not been working since 2017. All workers are fired. But from 2014 to 2017, the factory worked and paid taxes, for which the President of Ukraine, its owner, was constantly attacked at home for “financing the aggressor.” “Lipetsk factory” in Ukraine has become a household name, a symbol of “zrada”. The Lipetsk factory came back to Petro Poroshenko more than once even after the end of the presidential term. Ownership of this Russian asset is imputed to him as treason. Surprisingly, Poroshenko’s other Russian assets are not taken into account in Ukraine, at least in the same Lipetsk region. There is information that in different years, including in the post-Maidan period, he owned lands, agricultural holdings and sugar factories in the Chernozem region through figureheads. Also, Poroshenko’s asset was the Chaplyginsky starch plant, which supplied products to his confectionery factories. However, the ex-president of Ukraine already has enough problems. In Ukraine, many criminal cases have been initiated against him and all assets have been arrested.
